User Responsibilities

o Any applicable laws, regulations, and commonly accepted practices in your location.

• Keep your login credentials (email and password) secure and confidential.

If you suspect unauthorised access or a security breach, notify us immediately.

• Not share your login details or allow others to access the Services under your name.

• Only use the Website and Services for personal use or as permitted under a formal agreement. Commercial use is strictly prohibited unless approved by Your Tax Sherpa Services in writing.

• Not engage in illegal, abusive, or unauthorised activities, including:

o Scraping or harvesting user data,

o Sending unsolicited emails (spam), or

o Framing or linking to the Website without permission.

We reserve the right to remove unauthorised content, ads, or links without notice, and may pursue legal action for misuse. Automated use of the Website or Services is not allowed.

Payment Terms

• Subscription fees (if applicable) must be paid upfront through our approved methods:

o Credit card (Visa, Mastercard, etc.),

o Bank transfer, or

o Payment platforms such as Stripe, Airwallex, GoCardless, Wise or Square.

• By using these services, you agree to their terms and conditions, which are available on their respective websites.

• If a payment fails or is reversed, you are responsible for any associated costs, including bank fees.

• Fees may be updated at any time. If you're on a subscription, new pricing will apply after your current period ends.

Refund Policy

We may issue a refund if we are unable to provide access to the Services.

Refunds are at our discretion and apply only to the unused portion of any prepaid fee.

Each product or service has its own refund policy – refer to the relevant Letter of Engagement, Service Agreement, or product-specific terms for details.

Privacy

We take your privacy seriously.

All data provided through the Website and Services is handled in accordance with our Privacy Policy, which forms part of these Terms.

Access to Services

• To use our Services, you must purchase a subscription (if applicable) and create an account on our Website.

• When registering, you may be asked to provide personal details such as:

o Full name, email, address, phone number, tax info, and a secure password.

• You agree that all information provided will be accurate and kept up to date.

• Access is granted once registration is complete and payment is received. Your access remains valid for the duration of your subscription.

• You may not use the Services if:

o You are not of legal age to form a binding agreement, or

o You are legally prohibited from accessing our Services in your country.

General Advice Consultations

• Booking and Payment

All general advice consultations must be booked and confirmed in advance. Payment must be made upfront, either via our website or by personalised quote. All payments are made to The Accounting Academy Services Pty Limited (ABN 93 671 788 355), tax agent number 26233096, ASIC agent number 51435.

• Nature of Advice

These consultations are general in nature and should not be solely relied upon for tax return preparation or compliance. If you require personalised or specific tax advice, you must formally engage us through a Letter of Engagement or consult a registered tax agent or BAS agent directly.

• Refunds

Refund terms for consultations are outlined in your Letter of Engagement. No refunds will be issued unless specifically provided for under that agreement.

Accounting and Tax Services (including Structuring, Company/Trust Setups, Secretarial Support)

• Scope of Engagement

All professional services including tax planning, entity structuring, company or trust setups, and secretarial support are delivered under a formal Letter of Engagement issued by The Accounting Academy Services Pty Limited (ABN 93 671 788 355), tax agent number 26233096, ASIC agent number 51435.

• Individual Tax Returns

For standard individual tax returns, a formal engagement letter is generally not required, unless the situation involves complexity (e.g. investment properties, business income, residency issues, etc). By paying the fee and providing documentation, clients are deemed to have engaged us to act on their behalf with the ATO and authorise lodgement.

• ATO Authority

All clients engaging us for tax services must provide or confirm their permission for us to act as their authorised tax agent with the ATO, as required under Australian tax law.

• Refunds

Refunds for professional services are governed by the terms of your Letter of Engagement. In most cases, fees for government charges, lodgements, and legal documentation are non-refundable.

Nominee Directorships

• Engagement Requirements

This service requires a signed Deed of Indemnity and may also require a Director and Officer insurance policy before commencement. A Director ID is required for all domestic and international directors.

• Fees and Termination

Fees are due monthly in advance. Failure to pay within 7 days or to comply with tax lodgement obligations will result in immediate termination.

• Refunds

Refunds for this service are outlined in the Nominee Director Agreement and exclude any government or documentation fees.

Changes to These Terms

These Terms of Service were last updated on 17 April 2025. We may update them from time to time, and any changes will take effect once published on our website. By continuing to use our Services after an update, you agree to the revised Terms.
